My boyfriends mom is charging him with taking her ATM card. He already has a record, how long can he be in jail for theft?

It all depends on how much he took out of her acccount and whether he will be charged with misdemeanor theft or felony theft. Also what you need to realize is anyone who will steal from their own mother won't think twice about seating from their girlfriend. You might want to think twice about standing by him.

Although I like the idea of a kid being scared straight ..I have to say this threat of charging him with theft of her atm card doesn't hold legal water. If he took her card and charged fraudulent charges to her account usually the bank ends up writing off this debt. Just like if a stranger had stolen her credit card. It's not fair, but it is reality that it would cost more to prosecute than the amount of the theft. Now, the fact that he is stealing...and from his mother, when he already has a record doesn't make him sound like a good partner for you. Partner in crime, yes.. Partner in a relationship, no.
