Is it illegal to make an instructional video on how to do something illegal?

  • Like someone giving an instructional video on how to make crack cocaine, but never actually showing anything illegal (not using actual cocaine), or giving an instructional video on how to pick up a prostitute and never get busted. Hollywood does it all the time, but they but it under a different context. But if that's okay and not actually giving instructions on a video then it seems a little bit like a double standard. They both condone it and are giving people ideas. And then either upload the video to the internet with or without the intention to make money off of it--would this make a difference if they do it without the intention of making money? There is an instruction manual/video you can get on the internet that teaches how to ship marijuana through the United States Postal Service and never get caught, and that's being sold for like 15 bucks or something. So this stuff is definitely going on, but is it illegal or not? (in the United States)

    Hello E: It's not as black and white as you would like... Can YOU be charged if you do as you propose??? Yes. Will you??? I have no idea. But, don't think that just because you see OTHER people doing stuff, that you can do it too. If you're busted, saying Hollywood does it, and there's others on the internet doing it, WON'T serve you well excon

Free speech is not as straight forward as everyone believes it to be. Despite common misconception, the 1st Amendment does not entitle you to say whatever you want. It’s much more complicated than that. While making the video itself is not illegal, you can still be held accountable if someone uses your video to make the illegal drug and gets caught. For example, say a teenager makes the substance with your video’s assistance and overdoses. While it would be difficult to make criminal charges stick (not impossible though), the teenager’s parents could take you to civil court and, very feasibly, win. Take a look at a real life example. Just like with porn stars being digitally altered to look like they are below their actual age, it is a form of freedom of speech to instruct on how to properly do these things.

That stuff goes on for sure .. but I hardly think any reputable business/website would want to endorse or encourage illegal activity .. for moral and legal reasons. They could be setting themselves up for some big lawsuits.

There is a lot of gray area concerning this and you would certainly have to be careful. Say you were making a video on how to make crystal meth. Almost all of the ingredients and equipment by themselves are perfectly legal but if you had all or even some of them together and made a video on how to make it, that certainly would be more than enough for the police to charge you with felony intent to manufacture. A video on how to grow marijuana would likely be perfectly fine as long as you (a) didn't actually show yourself with a marijuana plant . Or (b) You live in a state that allows medical marijuana to be grown. I would suggest you not try it unless you perfectly understand what you can and cannot do.
