How can I make an advertisement?

can i make an ex employer pay for using my picture on an advertisement? They dont have written concent.

  • An ex-employer has a picture of me that plays on an advertisement at the movie theatre. They don’t have any kind of written permission to use the photo, and the photographer doesn’t have the permission either. I haven’t worked there for over 5 months and am thinking about charging the $100 a month and $500 for the past months I haven’t worked there. Could I make them pay for using my picture?

  • Answer:

It depends. How did they get the picture in the first place? Where you aware it was being taken? Did they use your picture while you were still working there? If any of those are correct, you agreed to them using the picture, and they don't need written permission. You probably could make them pay. However, I have a feeling that if you ask them for money, they are just going to stop using it.

I am hoping that they take it down because I am tired of people asking me about a store that I no longer work at. I also am thinking about charging them money for using it for the past 5 months that I have not been working there. I just don’t know if I could charge them that or not.

You can't. If it was taken while you were working there, and you knew they were taking it, and they used it for advertising while you worked there, you have consented to the use. The picture is actually their property, not yours. Legally, they owe you nothing.
