What Is Cooperation?

Our client threatens us physically if we don't do substantial free work for him. What is the best way to end the cooperation?

  • Background: We have been in a year-long cooperation with a client on a software project as technological vendors. Regarding the background of the client (and his investor), we have many clues that they are involved in shady businesses around the globe and thus we are not keen on ignoring the threats. The problem Everything changed, once they got a what we all believe is a fair quote on a new project of theirs. The client requested an extraordinary meeting with us where he showed up with his investor as well. The investor took over the conversation threatening us with involving Eastern European soldiers and hitmen (quite openly) if we don’t agree to deliver the new software for free. His rationale was that he has invested in us enough money already and that our projections from the proposal on the first project were overran by more than 100% (caused by the client tripling the scope throughout the project). Discussing the problem, explaining the situation and even pointing to the fact that contracts are on our side led us nowhere in the discussion except escalating the fury. Currently, we are looking for a way to end the cooperation as quickly as possible.

  • Answer:

You cannot think like an American or European in this situation. Threats of physical harm are coming from an international crime syndicate. Going to law enforcement will be dangerous. Syndicates like that buy the police as priority one. Protection goes to the highest bidder.  It would have to be someone in the questioner's country who will have the best advice.

Either you stay a victim in this story or you don't. If you really feel that you are in danger from this operation then you need to find some 'one' that can protect you. That someone might have to be some form of law enforcement agency. Whatever happens, you need to withdraw from from this situation. Maybe you could just 'find' a contract which means, as they have not yet agreed to the contract that you offered, that it wouldn't be possible to now fulfil it in the timescale as planned, that it would have to wait, say, a year, and that you are very sorry ..... One would also have to look from their point of view, how much would it be worth for them to spend the money and take the risk to harm you or your associates. Courage Gary
