How to start an Internet Company in India?

If an internet company in the US runs its business on a .com domain, then will it be illegal to launch a similar business in India with a .in domain if the US company has no presence in India?

• For example, REDBUS Group which owns the website redbus.com is a UK based investment group & redBus.in is a popular online bus ticket booking service in India which even owns a registered trademark redBus.in. This might be the case with some US-based company as well.

• Answer:

  If US based company have International trademark, then YES, it can be issue. If they don't have International trademark, and Indian company takes a local business Mark and doing business only and only in India, it will not cause issue. But if any of company will try to expand their territory, then ....   If domain is similar but Business is different and both have trademark in respective business, then again it cant be challenged. The redbus example given here, both companies have totally different line of work. So Ideally there should not be any issue. As in Trademarks itself approx. 60 different classifications, You are registered in 1 category, doest means that other cant do any business on same name in other categories. In general, Big corporates takes Trademarks in all classification internationally. Mid level or industry specific companies take in Similar group ( generally 4 - 5 class )
