Google has pending patent on my idea. What to do?

I have a revolutionary idea (patent under examination) for the retail market. Should I present it (with NDA) to Amazon or Google (they have 90% of the structure to implement it and they would overrun the competition) or should I implement it by myself (it would take a long time)?

  • The new technical idea is  related to the retail business. I applied for a patent and am waiting for examination results The idea would reshuffle the worldwide retail market Considering that the concept is easy to copy, I have two options: offer my idea to big companies with the required structure (first Amazon, then Google, then other) develop the idea by ourselves (two people at present) and searching for a financial support and more people (for example at Seedcamp, London) Two sub-options: Starting to develop the product and sell it to major retail organizations Attracting a big investor ready to put a huge amount of   money to create a new brandin the retail sector with a totally different concept. To 1: These big companies have 90% of the structure necessary to implement my idea. It would give them a cutting edge technology to beat competitors. Additionally they would get a lot of additional high value data. to 3: This is the easier way but leave time for other to copy and enter the market before us. The expansion later could only be linear and not exponential. It requires a cooperation with existing retail organizations. To 4: This could work but we have to find and convince an investor to put a lot (really a lot) of money in the project. This is the most difficult task but the one with the best financial return !. What is the best way to proceed and at same time protect (NDA ?) somehow my idea ?

  • Answer:

From what I've heard, you aren't likely to get much of a hearing at a big firm. They get these kinds of pitches "every day" and if they are working on something similiar and they listen to you, when you get your patent and then they release their internal project, you sue them for patent infringement and you ask for triple damages for wilfull infringement because they knew about your patents. Build a product and sell the company to Google/Ebay/Amazon/Facebookl

If I can advice you. don't think that big companies will buy your idea if you don't have the proof it works and if you have a competitive advantage towards us they cannot overcome( tecnologies, own market,etcc..). so you go and develop your idea. Running a startup will let you earn more than money ( ie experience, people,etc...)

I would suggest that you get the patent and try rolling out the feature that you are talking about. With some traction you can then reach out to then they use that data that you would now have to take a learned decision. They may choose to employ you or they may just buy you out.
