What privacy laws apply when moving sales leads through organizations utilizing mostly work-from-home or independent sales reps?

There are thousands of organizations that utilize work from home reps to grow their business. Sales leads containing personal contact information are collected independently by these reps and sometimes passed along to their teams or down-lines. Are there laws that restrict or regulate how these leads are to be shared within organizations with this structure?

Not really. You could argue that the leads are property of the company that paid to gather them, but it's not clear they'd qualify as intellectual property. Leads themselves are basically public information. That's evidenced by online leadshare sites like Jigsaw, etc. What you'd get in trouble for is downloading company data off of a company app into a file and keeping it. Without checking, I'd assume that data would be part of company property and keeping it would be considered theft. It's pretty much accepted that electronic data should be pervasive, it makes using it a lot easier. It's also accepted that sales reps will bring a "book" of clients or contacts with them into whatever their new job is. Nobody likes the idea of a rep raiding their lead database and taking it to a new company, but unless you've got at least minimal security set-up on your lead database, there's not much you can do.

If you are asking in regards to sales leads collected by home reps located in the US, and shared within a US contained organization, then I think the answer is no. I am unaware of any US privacy/personal data laws which regulate solely 'personal contact information', or its use or sharing within a US contained organization. When the collection occurs outside of the US, it becomes more complex, particularly when the EU is involved.
