Can someone squat on a trademark? 10 years ago I tried to trademark a name for merchandising/products. Someone in Canada owns it (registered in all areas I needed) but never used it. Won't sell it. Still has it. Still hasn't used. Can I dispute?

This is for a registered U.S. trademark.

Answer:
In the US, a trademark must (eventually) be put into actual use. You can take out a trademark with an "intent to use" designation, but after three years and a lot of paperwork, you will eventually have to supply proof that you are using the trademark in interstate commerce. http://www.uspto.gov/faq/trademarks.jsp#_Toc275426704 Canada seems to have similar provisions in their trademark act: http://laws-lois.justice.gc.ca/eng/acts/T-13/page-1.html
