How do I repair dead hard drives?

If a poor guy drives a car and gets in an accident with a Ferrari and it is all his fault, will it be fair to him and his family if he gets imprisoned for years because he didn't have money to repair the Ferrari?

  • Answer:

In the US, such an incident would not involve jail time, unless the poor person was committing a criminal traffic violation at the time of the accident.  And as far as civil liability goes, his insurance will cover the damage to some extent, but any overages that the poor person cannot come up with would be subject to a legal judgment, and the legal enforcement of such judgment through liens or other non-criminal methods. This answer is not a substitute for professional legal advice....

Hopefully that "poor guy" isn't an idiot, so he carries insurance. Also, I am not a lawyer, but I believe that loss of a civil case cannot result in prison, only monetary damages. And finally, if he was driving in a criminally irresponsible manner, then his ass deserves to be in jail whether he hits a Ferrari or a Ford.

In the US, the poor guy wouldn't end up in prison. He would get sued and he might have to declare bankruptcy, but prison, no.  And yes, that is perfectly fair. In the US, drivers should have car insurance, as much as they can reasonably afford, so if they do damage to another person, they can make that person as financially whole as possible. Prison, no, that wouldn't be fair.If you require legal assistance, please contact a lawyer in yo...

The poor person won't face jail unless they did something criminal AND law enforcement chooses to pursue it. If the poor person doesn't have insurance, or has insufficient insurance to cover the damages, they could be sued in civil court, and the court may award a judgement for the damages. The poor person would then have a few choices: a) work to avoid collection, b) work to pay it off, or c) declare bankruptcy to have the judgement wiped out. Finally keep in mind the Ferrari owner likely would have insurance, and his insurance would likely include insurance for uninsured motorists. As such it would be the insurance company going after the "poor person" not the Ferrari owner. To the degree the insurance company can't collect, it will increase rates for everyone, rich, poor or in the middle.

That is why you have insurance. And to avoid scenarios like this is why most countries require you to have third party insurance at the very least.

Only under medieval laws. In modern judicial system: 1. You can only be penalized for your own actions. What your family member has done is irrelevant. 2. There is no such thing as debtor's prison.

Most countries (Europe at least, which happens to be a bunch of countries) require you to have insurance for the case when you harm others or their property in order to even be allowed to drive. I am guessing both India and the US (the Quora mass) might differ on this issue. Update: I learnt that both India and the US requires third party insurance as well, so for most Quorans this whole story is a non-issue.

That's a good question. Like the other comments state, I hope that this "poor guy" has auto insurance. If he doesn't, he'll have bigger problems on his hands. It's so important to have the right coverage for you and your car. http://www.lowcostinsurance.biz/services/
