Is it justifiable to suspend Delhi Police Officers without investigation and without listening their views in recent conflict between Somnath Bharti and those Police Officers?

Answer:
I don't find any fault with the Law Minister: The Law Minister was trying to invoke the sections of Narcotics Laws, and the Local Police was invoking the normal CrPC. The local police had been ignoring the complaints by the local RWA and local temple regarding the prostitution racket and drug racket going on in Khirki since month. Law Minister wanted the blood test, Local police settled for urine test. The test was done in AIIMS. Also, to catch the drugs, you need blood test, not urine test. Here is the report from the local regarding the whole episode: http://www.deccanherald.com/content/381058/in-defence-aap-minister039s-039vigilantism039.html http://www.ndtv.com/article/india/read-letter-from-ugandan-high-commission-cited-by-aap-473194?curl=1390306211, whch although is 7 months old, talks about the similar things. There is definitely something very fishy with local cops, when locals, RWAs, temple, and even the High Commision of Uganda has talked so much about the issue. Till the investigation against the cop is going on, it is of course sensible that the local SHO be 'shifted' to some other place, to ensure the free and fair investigation

Not at all, everyone should be given a hearing, and when the L-G has constituted an inquiry commission, there was no need for the CM to sit on a dharna as well. Anyways, I dont feel the police officers did anything wrong, they refused to arrest 2 foreigners without an arrest warrant and refused to barge into someone's house late at night without a search warrant and without any credible information, for all I know. You just can't harass people just because a minister says they are guilty.

I can understand if this was some political issue, but doing a dharna in front of the Home ministry for an administrative/legal issue is nothing but a gimmick because there are constitutional means of resolving such issues. If the complaint is that the police is not registering an FIR, the AAP members or residents of that area can file a complaint with the area Chief Judicial Magistrate. IF the CJM finds that the police were delinquent in not filing an FIR then he can send the policemen to even jail. Can anyone enlighten whether a complaint has been filed against the police with CJM for non registration of FIR ? This would be the correct constitutional and legal process to handle the issue rather than the CM doing a dharna in front of the home ministry.
