Want to bring my wife from Thailand: K-3 or immigration visa?

My stepdaughters US Visa was denied in Thailand. Should we reapply in Canada?

  • Long story short: I am admitted to the US under a TN Visa. My Thai wife got a TD visa. We want to bring my stepdaughter to the US as well, so we applied for a TD visa. I was denied entry into the embassy, my wife had to go alone with my stepdaughter, she was not well prepared to answer questions, visa was denied: 214(b). Immigration attorney is on holiday. We believe there is no point of reapplying in Thailand right now, but there may be a chance the Visa gets approved in Canada. So, what are the chances?

    I have a little experience with this sort of thing, being Canadian, having held many TN visas, and having helped my VN wife get a tourist visa to the US from Vietnam. Long story short, I think you are right that you will have a better chance applying from Canada.  You can do this if you can show that your stepdaughter is a resident of Canada by having a visa allowing residence in Canada. Otherwise they will not accept an application from Canada if she is just visiting.
