How does a 3-day notice work?

How do you get Canada's "notice and notice" internet copyright protection system to work for small copyright holders?

  • What recourse does an individual who is an author and translator have when someone ( a large multi-national company in this case) takes their work, for which they own the copyright, and posts it online with only minor changes, without having paid for it or licensed it?  I have heard that Canada's equivalent to the US-style "takedown notice" is called a "notice to notice"system, but I haven't been able to find much information about it.

    You probably refer to Canada's Modernization Act http://laws-lois.justice.gc.ca/eng/annualstatutes/2012_20/FullText.html My understanding is that like in the US, you notify an ISP that copyrighted material is used with no permission. In return, they notify their subscriber. From - http://www.ic.gc.ca/eic/site/crp-prda.nsf/eng/rp01188.html "Creating a notice and notice regime: The Bill formalizes the voluntary "notice and notice" regime currently used by Canadian ISPs. Under this system, when an ISP receives a notice from a copyright holder that a subscriber might be infringing copyright, it forwards a notice to the subscriber. The identity of the subscriber may then be released with a court order. This uniquely Canadian approach has been effective at discouraging infringement and is consistent with Canadian values."
