Can you think of any examples where a consumer's data has been processed 'unfairly'?
-
In 1997 the UK's Office of the Information Commissioner (ICO) issued guidance to all banks and lenders in the form of a document which was subsequently dubbed the 'Principles of Reciprocity'. This document outlined how different institutions need to report information to Credit Reference Agencies in a consistent manner, so as to ensure that consumers' data is being processed 'fairly' according to the Data Protection Act 1998. This is an area that I'm really fascinated in; the idea that data must legally be processed 'fairly' by data-holders. The concept of fairness sits across other digital rights and responsibilities, like the right to hold data securely, to use it for its intended purpose etc. What I'm interested in are examples where you might argue that data has been processed 'unfairly'. An example I'll give - or argue for - is that case of retailers processing debit card payments. Some retailers process the payment instantaneously and so your bank account reflects the payment made immediately. Other retailers process transactions in batch and so it can be 5 days after you made the purchase that the transaction shows in your account. I'd argue that this was 'unfair' processing of data, as inconsistent processing by different data-holders makes it difficult for consumers to manage their bank accounts and statements. Any other examples specifically of 'unfair' processing?

Answer:
Bank of America does daily batching of debits and processes then from largest to smallest. This maximizes the probability of them being able to charge you with as many insufficient funds fees as possible.
