How To Clone Website?

Can I patent an idea before launching a website,so that no one clone those features again and launch their own website?

  • Let me give you an example of a website which launched and soon had dozens of clones in many countries. GROUPON is the site which is one of the fastest growing companies, would it had been possible that if Groupon had patented their idea which led many of its clones came after its launch and many of them became its competitors. Well there are dozens of examples, please let me know if you know regarding this field.

  • Answer:

You are going all wrong about your idea. First you cannot patent an idea, no matter what you read on the web. Just have a quick consultation with any patent lawyer and he/she will tell you the same: No. As previously mentioned here you can patent certain processes but it is not the same as an idea. Instead of thinking how to protect your idea start building it. If it is really that original and profitable people will always find a way to go around your "patent". Fighting patent battles is long and expensive process for all parties involved. If you are first to market this will allow you to capture the attention of the media and most importantly your users/customers. Concentrate on creating a superb product and leave all this patent talk.

You can certainly FILE for a patent of your proposed Web site before you launch it.  However, this will not stop other people from copying it. If and when your patent issues (in at least 3 years, and that's a LONG time for Web-based applications), then you can go after them. Until then, there is not much you can do.  If you believe your idea is unique and not obvious, you should certainly file. As a side note, you can't just patent an idea: say the idea of "giving away daily coupons". You need to specify the exact steps by which the site offers and provides daily coupons and how users interact with that web site.
