Best missionary college in the United States?

Is it true that a (hypothetical) person brought to the United States when he/she was one day old who then grew up in the United States, graduating from college, would still be considered an illegal immigrant if he/she had no green card?

  • Please provide a link to support your answer if possible. Edit: My meaning is that they arrived illegally and/or overstayed a tourist visa. At some point early in her life, the child was illegally in the States and never left. Edit 2: Assuming the child's parents are both non-US citizens and were not in the US legally.

    Subject to both your edits, your statement is true, and is also true in pretty much any other country on the planet. I know of no country where if you aren't a birthright citizen you can attain citizenship or even legal status by simple physical presence in the country without any formal naturalization procedure.

Yes. Although if the baby had been abandoned at a fire station or a hospital, it would have been given a birth certificate of the town where it was abandoned and it would be a US citizen.

The DREAM Act is a proposal to change this and a few other scenarios. (it's been proposed for a while).

If he/she had American parents, then he/she would be considered an American citizen. He/She would then have dual citizenship. However, if the parents were not Americans, then yes, they would be considered an illegal immigrant.

As long as they have a valid nonimmigrant status, or are otherwise allowed to stay here due to pending change of status, they are not illegal immigrants. They don't have to have a green card.
