What is the name of this font? Are another font similar?

Will it be a trademark infringement if we use the popular VAG Rounded font licensed through Adobe Systems for our start-up logo and use similar colors as used by a reputed company in the same industry, but with a "totally different name"?

• Our logo does not contain any image or special graphics, but it's just a website name made up of a three-word English sentence styled using VAG Rounded font, but uses similar colors as used by a reputed company in a similar business but with a totally different name.  We are starting-up in India. The Legal Notice here - http://store1.adobe.com/cfusion/store/html/index.cfm?event=displayFontPackage&code=1130 says, VAG Rounded Std is a trademark of Linotype GmbH and may be registered in certain jurisdictions. Not sure if this can be registered in India in our case! Please advise.

  Answering your question in two parts: Can the name be registered by using the font ? You are confusing the rights over the fonts with the rights of using the fonts. You are protecting the name, not the font. The font is provided for usage, you cannot claim the font as your own, but you may claim the art work you create using the font as your own. GO ahead, using the font should not be a problem. Do consult a trademark lawyer if you still have doubts, i am not a lawyer. Will the other company sue you for trademark infringement  ? There is an easy way to answer this question. Show your logo to people from the industry for 3-5 seconds only . If they confuse it with the "other" company's logo, then the chances are high you will get in trouble. If the survey group does not confuse your logo with "other" company's you probably are in the clear. Hope this answer helps.
