Can I break my lease in a HUD subsidized unit if my neighbor has been sexually harassing me and broke into my apartment?

He also stalks me and will report to my friend who and when a person is at my apartment and when they leave. I have had a lot of stuff go missing in the past few months and I came home to find this neighbor in my apartment walking out of my bedroom. I locked the door before I left. I filed a police report about everything and gave a copy to my property manager with a written letter requesting the locks be changed and I be relocated to a new unit in the complex or the area. I was told they would be moving me but that they are "really backed up right now". So, i will be stopping in again to push for a new location to live in. How long is to long to wait for this? I am afraid at this point because this person is also trying to cause me all kinds of problems. I am disabled and trying to finish my education so I can be off government assistance and go back to working. I got a letter in the mail that my food-stamps and healthcare will be cut off unless I prove I have no income? I really want to be done with this person... What can I do? They are no longer providing me with a safe place to live!

Nope ... you would have to prove there was a reasonable expectation for them to provide protection to you ... and courts have constantly ruled that you don't even have that expectation from the police. You can change the locks yourself, if the manager doesn't. I have ALWAYS changed the locks, when I move in to an apartment or house. Then I give one copy to the manager, with a written notice that I *WILL* expect them to abide by the laws regarding when they can grant access to my domicile. And failure to do so will result in me changing the locks and filing a civil suit against them. The other thing you do is secure the windows.

You need to contact your case worker and show the police reports. They will also talk to the manager. The manager also has someone they report to and I suggest you call them.

I do not believe you have grounds to break your lease. I suggest that you discuss the issues with an attorney (possibly the County District Attorney) and notify the police regarding things that you might normally report to them.
