Can you claim child support on your taxes?

Can my baby daddy claim our daughter on taxes when he doesn't pay child support?

  • I have a 22 month old daughter and was wondering does her father have legal rights to claim her on taxes without paying child support all year? He gets her every weekend and doesn't pay any child support but maybe $10 every like 4 months and my dad has been paying for her diapers, clothes, food, gas to take her to dr's , insurance for the car and everything else she needs all year and he is saying he has a legal right to claim her on taxes for this year so does he have any rights to claim her? I have sole custody of her. Please help me so I can let him know and he will drop it thanks. Oh and we haven't been to court over anything and she has my last name the only thing that proves she is his is the DNA test he ain't even on the birth certificate and he is married with another daughter now.

I'd report him to the IRS and just leave it at that. try to have some evidence for them to use in it, like reciepts for everything and all that. he deserves some prison time for screwing so many people around and tax evasion.

I don't see how he can legally claim her. You need to see a lawyer and get things legal for your sake and for your daughters sake. The lawyer needs to file for you to get child support . How did you get custody if you haven't been to court? You need to see that lawyer right away.
