Stop neighbour entering my garden to cut her trees?

Neighbour wishes gardener to enter my property to cut her the trees which are in her garden. Can I stop my neighbour from doing this?

Yes you can but are you prepared to trim your neighbor's tree because it sounds like they are keeping it off your side. You didn't say the people coming on your side are doing any damage. If they are I suggest talking to your neighbor about avoiding future damage. I would be as nice as possible because getting on bad terms with your neighbor can obviously have a serious negative effect on your life.

I suggest finding out what kind of equipment they plan on using- the guy next door to me wanted to park a CRANE on my driveway so they could work on his trees- I LOL at him- the weight of the thing would have DESTROYED the driveway. Additionally, when you do have tree work done- make sure they have INSURANCE! Their insurance company must get the copy of the policy DIRECTLY from their insurance company- no home owner or tree company involved. Tree companies are notorious for buying, then canceling the policy because of cost. I would also want to be assured in WRITING that what ever they cut- they clean up entirely- and if they damage anything on your property - they pay to replace it or you file a claim against their insurance. If they are working on your property, the insurance papers have to be exchanged with YOUR insurance company as well- it's the only way your covered.

Thank you for all the comments. I do not want the trees cut on my side because they intend taking off all the greenery including the branches on a permanent basis on my side leaving bare exposed wood (approximately 12 feet high) but leaving all the greenery on their side. To get to my side of course they need to access my property on my driveway. I know about this due to the gardener they employed happens to be my gardener and he informed me. This neighbour caused a problem about 16 years ago not letting us access her garden to harl the side of our garage and we received a Solicitors letter informing us we hadn't to enter her property. I am not doing this as a pay back - I just don't want bare exposed wood facing me on my driveway.

Yes. You are within your rights to refuse the gardener's entry to your property. However, it may be easier to let them do this as then you can insist they chop down any branches hanging over your side.
