Michelle - you are so wrong. You may be surprised to learn that federal law doesn’t give employees the right to time off to eat lunch (or another meal) or the right to take short breaks during the work day. Although employees must be paid for shorter breaks they are allowed to take during the day, employers are not required to provide these breaks in the first place. Plenty of employers provide these breaks as a matter of custom and policy. Sensible as this seems, employers are not legally required to allow breaks, at least by federal law. Which means that these so-called 15 minute breaks twice a day have evolved so employees believe it is the "law" It so is not. At least by federal standards. That's what the "matter of custom" means. It has become commonplace that employees believe they are entitled so employers have gone along with it. Employers - in most states - can stop these breaks any time they want - or not allow them in the first place. That's federal law - state law is a different story, however. A number of states require employers to provide meal breaks or rest breaks. Illinois requires most employers to provide meal breaks. Illinois employers must provide a meal break to employees who work at least seven and a half continuous hours. This break must be at least 20 minutes long, and it must start no later than five hours after the beginning of the shift. These are unpaid breaks; employers are not required to pay employees for this time unless employees have to work through their breaks. So to answer the question - on a 10 hour day - you should be having at least a 20 minute meal break after 5 hours. Unpaid. No other breaks required unless it is their policy to give them. So you could possibly be allowed to take a 10-15 minute break one day - but not the next.

If requested, by law you must give breaks if over 5 hours. If you don't have breaks you can request some. If they refuse honestly get outbid the job.
