You can video record "Anyone" in public where there is no expectation of privacy. Police are no different than anyone else. Is does not matter if this is a "crime scene/evidence". Know your rights. "When in public spaces where you are lawfully present you have the right to photograph anything that is in plain view. That includes pictures of federal buildings, transportation facilities, and police. Don't read internet links to BS. No state has a law against video or filming the police on the street in normal circumstances. Many do when there is an UC or at a crime scene to preserve others rights. A couple of states, Florida and Illinois come to mind, have laws against any voice recordings of anyone, not just the police, without the permission of the person(s) being recorded. The courts in all of those states have, in the past few years, decided that specifically recording your interaction with the police is the same as taking notes and is therefore completely legal. Others, not having an interaction with the police, say a passenger in the car when police have stopped the driver for a violation, still cannot record in states that ban audio recordings without express permission. The original idea behind banning audio recordings was put in palce to limit the right of police to surreptitiously record individuals in public palces
Freedom of the Press is a broad term that covers this in all states. Only exception may be in the case of a crime scene/evidence.

I don't believe there is any state in the U.S. where you are not allowed to film police. In the article that you provided a link for, the guy was charged for audio recording someone secretly, which is illegal in several states under wire tapping laws. If he did not have audio or if he had not done it secretly, there would be no violation. In most states, you can record someone as long as you are present or have permission of one party who is present. In several states you have to have the consent of everyone present, but that only applies to secretly recording. As long as you let them know you are recording the conversation it is legal throughout the U.S. You can find the states in the link below.
