    New York Family Court Act, section 301.2 defines a juvenile delinquent as someone older than 7 and less than 16. If you're over 16, you can't be a JD in New York...go to adult jail. In addition, Criminal Procedure Code section 1.20 defines crimes and ages for which one can be designated a "juvenile offender", eligible for transfer to adult court. For Murder 2, a 13-year old can be transferred.
