Can a new sponsor apply for new Visa for me?

My sponsor got banned on 457 visa and Ian holding my 457 visa from last 1 year but still need to know we can apply for permanent residency?

    I'm not exactly sure what you mean by 'My sponsor got banned on 457 visa'. I assume you mean that your sponsoring 457 employer is no longer allowed by DIBP to be a 457 sponsor. Have you been advised by DIBP if you are allowed to continue working there until your 457 expires? Even if you are allowed to continue working there, you can only apply for a permanent visa via the Temporary Residence stream after you have worked for your 457 employer for 2 years and if that employer then sponsors you for a 186 ENS or 187 RSMS permanent visa. If your employer has been banned from being a 457 sponsor, it's most unlikely that they would be able to sponsor anyone for a 186 or a187. In order to get PR, the following are your options... • If you can meet the requirements (i.e. skills assessment and at least 60 points) for a non-employer sponsored permanent visa, you can submit an Expression of Interest (EOI) in applying for a 189 Independent visa or a 190 State sponsored visa (you will need state sponsorship for a 190). OR • You will have to find a new 457 sponsor who is willing to sponsor you for a 186 or 187 in the future. OR • You will have to find a sponsor for a Direct Entry 186 or 187. Note that for that to be a possibility, you will need to meet the additional requirements for a visa via the Direct Entry stream for that visa. For a 186, that includes skills assessment and 3 years experience. For a 187, the work must be in a regional area and you MAY need skills assessment (usually only for trade qualifications obtained overseas but can also be required by your Case Officer for any occupation). EDIT: Sponsors get banned for all manner of reasons with fraud being a fairly rare reason. The most common reason is that they haven't been meeting meet their sponsorship obligations e.g. they don't pay their sponsored employees the same wages as other employees or the working conditions are substandard or something along those lines.

Ozmaniac knows her stuff, and gave you the requirements. However, if your sponsor has been banned from 457 visas, there's a good chance there's some sort of fraud involved here. If so, participating in any fraud gets you barred from Australia for life. If you do not exactly meet all requirements as specified, then somebody was doing the dirty & you need to get out of Australia and stay out. Not too many employers get "banned" so it's very likely to be a sign of serious trouble, and you're caught in it.
