Not knowing if you are in the USA or not, it is hard to answer. However, if you are in the USA there are a few laws that apply. The first is the Americans with Disabilities Act. This is for any person with a diagnosed disability. However, most important to children is the Individuals with Disabilities Education Act of 2004 is the main source of special ed law in schools. I would look that up on the 'Net to find out what the steps are to identification of children for special needs programs. Also, newer to the situation is Response to Intervention or Multi-Tiered System of Supports (MTSS) that is required to be implemented by a child study team before a referral to special education. This means that the child has to go through three increasingly supportive interventions over a period of time, during 2which progress is documented. If none of the interventions work, then a referral is made. However, I think for your purposes, looking at IDEA may be enough, I just wanted you to know that this other system is now in place.
