It depends on what you mean by "in trouble". Could you be arrested? Sure. All the cops need to do to arrest you is have reasonable suspicion that you are guilty of a crime. It's then up to the DA and the courts to prove it. If the cops can't prove it, you won't be convicted, but you'd still have an arrest record.
