Current court civil cases?

Why is Narendra Modi asking MPs to request that the supreme court fast track their pending cases, knowing quite well that there is no option otherwise?

  • Here are the facts : 1. June 12, 2014 : http://www.newslivetv.com/top-news/modi-to-mps-ask-sc-to-fast-track-your-cases.html Here Modi goes on to say : "Would it not be better if the guilty are punished? Then every time you file an affidavit you don't have to put down a case that some NGO will highlight as a pending criminal investigation," Modi said in Rajya Sabha while replying to the debate on the President's address to Parliament. 2. Mar 11, 2014 http://timesofindia.indiatimes.com/india/Finish-trial-against-MPs-and-MLAs-in-one-year-Supreme-Court-orders/articleshow/31802285.cms That is 3 months ago the Supreme Court had already ordered that the pending cases against MPs and MLAs need to be heard on a day to day basis. Quoting from the article : "The order, passed by a bench of Justice RM Lodha and Justice Kurian Joseph, ends the last hope of MPs and MLAs of evading early adjudication of their alleged guilt and a possible conviction resulting in a sentence of more than two years or more, which generally follows in a corruption case or in serious offences." This much needed reform was brought about by http://www.publicinterestfoundation.com which is ironically an NGO. So here is the deal : MPs cannot dictate Supreme Court to fast track their cases, as we always know "the law takes its own course". MPs have no option but to see their cases get fast tracked due to the March 11 order. They would rather want to not get their cases fast tracked. Isn't that obvious. Any good person would be crying out loud to get their cases fast tracked but never heard any MP doing so. What is the need for Modi to chide the NGOs which are working for reforms in governance. People have legitimate right to question the government on tainted ministers. He should have rather thanked the people at "Public Interest Foundation" for helping bring the reform rather than trying to appear a "messiah" against corruption. Isn't this an unethical case of wiping other people's credit and trying to present a larger than true image of self?

Joke answer : It is like mother telling a child to look before crossing the road. Any sensible child has to do this. But a mother will still remind them. On serious note : Of course it is a show off to appear to be the one cleaning up politics, when it was NGOs tireless work that is cleaning up the politics. But it is a welcome change for Indian politicians in power to obey SC orders pertaining to criminal cases against politicians. Most of the time politicians use their strength in parliament to amend laws so that SC order won't be valid any more. The landmark 2002 order of the Supreme Court making it mandatory for candidates to declare their criminal, financial and educational background was in response to a Public Interest Litigation (PIL) filed by the Association of Democratic Rights (ADR). When the Election Commission issued an order to implement the Supreme Court judgement, an all party meeting was held and it was decided that the Representation of People Act should be amended to prevent the disclosure. But parliament was adjourned before that and the government then issued an ordinance. ADR went to the Supreme Court against the ordinance and the Supreme Court declared that ordinance was unconstitutional and null and void. This was under NDA. Similar things happened when SC ordered disqualification of elected representatives convicted for more than 2 years. UPA brought a amendment that failed to pass, then they tried a ordinance which after protests from several corners was scrapped.  Taking credit for others work is part of politics in India. Though it is expected of them, It would be fantastic,  if Modi led BJP govt does not use their numbers and let law take its course. I hope it happens so.

Of course it is taking credit but it is not bad considering MPs have the power to reverse judgements if they wish. E.G shah bano case, RTI for political parties case, So it is good that MODI is making concensus for the judgement and not against it!
