Who is a medical clerk?

If a clerk sells alcohol to a minor who presented a real ID that was someone else's, can the clerk be charged with anything?

  • This is for New York by the way. If someone at the register rings up a minor who had someone else's ID that was legitimate, is the clerk liable for any charges?

  • Answer:

Yes Fake Id or stolen Id , it does not matter. The vendor is held responsible for selling to a minor, no excuses. To set up the law otherwise would simply allow every vendor to deny responsibility for actually checking an ID is valid. All authorities are required to do is prove the sale happened, they're not forced to prove a lack of diligence.

Other answers

Yes. If the clerk isn't certain that the person on the ID is the person in front of him, he can refuse the sale.

It depends on your state. You can definitely count on getting fired, though. Possibly a fine. Check the Alcohol and Beverage Commission website for your state.

The 18 year-old is in a world of trouble with the stolen or "borrowed" ID. Theft or even "borrowing " someone else' s ID is a felony in many states. If reasonable care the store might be off of the hook. People do change their hair cut , color, lose or gain weight . If the difference is very obvious , then no. For example :The name Kelly that is a female indicted on the ID, but a male in person.

I don't think so. However you might reasonably expect due diligence in the inspection of the ID to see that it corresponds to the person before you.
