Is it legal to get paid less than minimum wage at a seasonal job?

Can you go back JSA if you quit a job that pays less than minimum wage? (If I don't get quote I don't get paid)?

  • Answer:

Contrary to common belief it is possible to leave a job and go back onto JSA, a decision maker would decide whether your reason for leaving was good enough or not and that could be some weeks or even months after the claim has started, and you would be paid JSA in the meantime. They do not automatically say you can't get benefit because you left and I think you have a good enough reason for leaving, which is that you aren't earning anything. Or, another option would be to claim income support, because there is a minimum amount the law says you need to live on and you are not achieving that. You would need to supply proof of this, though like bank statements.

It's not quite that simple. If a job is purely commission based, you cannot be an employee (because you aren't going to be guaranteed earnings at least equal to the minimum wage), so you are now self-employed - and that's why it isn't simple! It really is one to discuss with the JobCentre, I'm afraid.

Go back to the job centre and tell them what you are telling us and they will tell you what you can do
