Is it legal to stay with my boyfriend/girlfriend in a lodge/hotel in India?

  • 1. My boyfriend had come to Hyderabad, where I stayed, to celebrate my birthday. As he came just for two days, I wanted to spend my entire time with him. So, I stayed with him in a nearby lodge. It was not a red-light area. But an inspector with four constables came to our room in the night at 2'o clock and harassed both of us. He even slapped my boyfriend. They started to say that we were doing prostitution. He said as we're not married, its not legal to stay in lodge. He snatched our ID cards and took some photos in his phone and threatened us that he'll publish our photos in newspaper the next day. Later, the lodge people asked us to sort it by giving him 5000 rupees. We got out ID's after giving the amount. I was wondering whether it is illegal to stay in a lodge with my boyfriend? We both are majors and don't we have right to stay with anyone we want? Can we book a complaint against him? Do the lodge people have responsibility of their customers? I feel those lodge people were involved in this, as he served as mediator to send the money to that inspector and bring our ID. Can we book a case against the lodge manager? He was supposed to warn us earlier that unmarried couples are not allowed in his lodge.2. I am meeting my girlfriend after quite long time. Since we would be spending a day or two in delhi, I am wondering if it would be safe to stay with her in a hotel. Is it legal in india for a unmarried couple to stay in a hotel(we both are adult as per the law)? Would there be any problem with the police if they come for raid or something?

    Yes, it is completely legal to stay in a hotel room with a girl (who's not your wife) ; there is no legalities issue. You may face problem with moral policing, so I suggest you not to stay at low quality hotel. You can give your legal documents to the hotel which is formality now a days in most of the India now. There should not be any problem at all after that. Alert: Do not pretend to be husband and wife! it might land you in trouble. Instead just book a room normally.

yes it is legal why not ,for example mansoori and shimla you can take girl with you in hotel and get room easily no problem

Hell no just make sure you don't give wrong details to Lodge most of people scared. Second factor is not in your favour is parents police will come and threaten you to call your parents. It's not illegal be brave in such incidents normally I see here some kind of scam with Lodge owner, did you asked him about his I'd card? We have right to ask about I'd card, is he in uniform? Is he on duty? You need to go with that police and meet their superior inspector normally this kind of things done by havldar and sub inspector etc etc so going to higher person will scare him Remember don't be scared in such incidents they equally doing wrong so use their fear against them He don't have any right to slap and taking pictures you can give him Id card and tell him to leave and ask for address of police station. I will slap back BC they do not have any right to touch physically period. --- Above thing have disadvantages too like I mentioned they will call your parents if they are able to get number from you so people got scared and give them money Be ready to fight If possible keep numbers of journalists or police to whom you know and speak with them what is next thing to do if they know you are following right approach they will not harm you but main thing is to become brave in such incident This type of thing can happen anywhere not just in Lodge teach those Fuckers lesson P. It is absolutely legal to stay with your boyfriend/ girlfriend in a lodge/hotel in India.But there are some fools in India who are more interested in other people's lives than taking care of their own s**t and who may be not at all having either knowledge of or respect on our Indian constitution. And what they do is termed as "MORAL POLICING". What's the worst thing which is happening in our country is even some police officers do this and they support the fools who are doing this. The hotel staff  also refuse to give permission to unmarried couple to stay in the hotel because they fear they may have to face problems with the police or some other folks. Nobody other than the god knows whether the government is taking any actions to curb this kind of disrespect to the Indian constitution and Human rights. Some police taking the law in to their hands  and some media instead of educating people giving support to this for their TRP rating is the worst thing. They should be the protectors but they are being the villains by doing this directly or supporting the hooligans who do this. Youth in India should take responsibility to curb this MORAL POLICING in India and my sincere thanx to people who are fighting already. It's none of anybody's business what some adult people do inside a hotel room.

These cops are screwed up. Legally , if you are a major and a consenting adult, he doesn't even have the right to question you. But this is India and cops don't have any sense of duty, they just want to pocket some money .  luxury lodges handle this themselves, the smaller ones sometimes are hand in hand with the cops in these sort of situations. Technically you can lodge a complaint but your parents may be contacted .  Best thing to do is put this behind and move on and from the next time you can chose better places to spend time at.

Its bullshit. No one can stop you to live with your boyfriend in a hotel. Its not illegal. Some cheap lodge and hotels have this sort of setting with policemen so that they can get a bribe from innocent people.I would suggest just go for atleast 3 star hotel and you will find no problem at all. They just need your ID proofs. Also, your body language speaks a lot when you check in the hotel. Show decency so that hotel employees will not make any trouble to you. Its India, we judge people by its personality and looks so use this mentality and manipulate them to get this things done easily.So, find decent hotel, show decency and have funn!!

It is legal but unfortunately not socially accepted and this make things bit dirty. Police can use this against us, blackmailing and asking money. Now you can go for court case and all but you dont want your parents and even press to know about the incident. Then comes the whole "Ghar ki ijjat" issue. We seriously are messed up.Few years back, I confronted a police constable for harassing couple in public. He just said "If this girl run away with this guy, the parents will come to us to make our life hell with an FIR against the boy". Sadly love is not accepted in our society and we can not do about it rather than being rebel.Now coming to the interesting part. It is not illegal. As you said the hotel manager has a definite hand in this . there is no doubt about that. They might have done this to other couples(who are lovers). ie milking money. even if they booked a case you both would not have any problem . its difficult for police to prove in court. because you both are majors and stayed together with consent only. only thing is that attending case will kill your time . but having given the money already its difficult for you to prove in court that the police asked bribe via mediator(manager). you have not given that if you paid money via online transfer or cash . most likely you would have given cash . they (manager +police)do not want electronic trace of cash given to them . do you have any proof of "threatened us that he'll publish our photos in newspaper the next day". unlikely that you have. if you dont have then its difficult to prove even if you file a case. only you will pay lawyer fees each month . for the second question no problem if you choose decent hotel or resort . just book online. use makemytrip/expedia/cleartrip like websites. use top rated resorts. not expensive. no police raids will come .

If you go for a good hotel, no its not at all a problem. Carry your valid ids, and that is it. Staying with a female in a hotel is not  illegal at all. Be confident, don't fear so that no one can blackmail you and threat you.I would suggest you to go and prebook a room on your name for two or may be online you can. No one asks anything if it's done online.  Just carry valid ids both of you issued by govt. Of India.
