Suer can. Without the permit, the covered patio is an unlicensed structure - if they are adamant, your options are going to be get the permit or tears down the structure. Doesn't matter if you erected the structure or not - it was your obligation to ensure that all additions or modifications to the house were properly performed (permitted and up to code).
