How is Amity allowed to run under a fraudulent founder?

  • First of all, some background on the topic: [1] Amity is now a huge education provider in India, founded by Ashok Chauhan. [2] http://www.livemint.com/Companies/P2ih91HPRm8mtfCZwM3OaM/Controversies-dog-Amity-but-students-keep-streaming-in.html - In an email interview with Mint, Doris Möller-Scheu, a spokeswoman for the prosecutor in Frankfurt, confirmed that Ashok Chauhan was charged with fraud in 2000. “He is suspected of having given five promissory notes as a security in order to obtain a credit of €1.5 million (about Rs10 crore at the current exchange rate) from two banks in 1994. Later these promissory notes were dishonoured, because the drawees were insolvent,” she said, adding that the prosecutor’s office in Frankfurt sought his extradition from India. But the Delhi high court rejected the request in 2005. Son Chauhan terms the charges as small. He says they have been but blown out of proportion by people who want to blackmail and extort money from the Amity Group. He, however, did not say who these people are. [3] http://usatoday30.usatoday.com/news/world/2007-12-22-3857696469_x.htm - Chauhan and his brother, who ran a network of companies in Germany, were charged with fraud after allegedly cheating two banks out of nearly $2.2 million in the early 1990s, said Doris Moeller Scheu, a spokeswoman for the prosecutor in Frankfurt.  Through a spokeswoman, Chauhan denied the charges. "This is some wrong information," said Savita Mehta, Amity's vice president for communications. She did not respond to repeated follow-up calls. [4] http://rti.india.gov.in/cic_decisions/AD-18082009-01.pdf - the texts of these warrants are already in the public domain (available on the  internet) and indicate the alleged involvement of the two individuals ... In the light of its above observations, the Commission allows the appeal and directs the CPIO to provide complete information to the Appellant by 15 September, 2009 under intimation to the Commission. [5] http://www.tribuneindia.com/2009/20090825/main7.htm -  The minister also stated that the Embassy of Federal Republic of Germany in India had requested for legal assistance in serving documents/extradition of Ashok Kumar Chauhan and Arun Kumar Chauhan and that as per Article 6 of the Extradition Treaty between the Republic of India and the Federal Republic of Germany neither of the Contracting States shall be bound to extradite its own nationals. However, as per the same article, criminal prosecution may be effected, in India. Therefore, Ministry of Home Affairs, which is the nodal Ministry in such matters have been requested to proceed in accordance with law, he said. Charges were accepted by his son, and a $2.2m charge termed as small in [2], denied by a spokeswoman in [3]. [4] is an RTI request filed by Mr. Ashwini Kumar Shrivastava and is summed up in [5]. [2] States that Delhi High Court rejected the extradition request, but [5] adds that "criminal prosecution may be effected, in India" and "nodal Ministry in such matters have been requested to proceed in accordance with law" which apparantly never happened? [4] also states that the red corner notices are available online (453/1990 and 459/1998) though I wasn't able to find them, nor the CPIO reply to Ashwini Kumar as directed in the RTI. Would love if someone can hunt those reports down and post the links here. --- I'm not an expert in law or its proceedings (I'm still in 11th grade) or can completely make out what should have been done in this case. But after reading the above links, one can definitely smell something mischievous and that's why I turned to Quora. What I want to know is your view on the topic: 1. Is education in India really led by worthy founders? We're a part of a huge fraud ranging from this to IIPM (though I don't want to focus on IIPM in this question). 2. Did the legal system not do its job properly in the above case? Was it influenced by the alleged parties? 3. Can we fix the system? How?

  • Answer:

I do not know much about Amity, it may or may not be a decent university. However, it is the culture, students, professors and alumni that really make an university, not necessarily the founder. A case in point is ISB which continues to be a great business school even after Rajat Gupta's fall from grace.

Money  and power do a lot in India. I was recently a visitor at said person's  residence in Defence Colony and right behind me at the waiting room  there was man in saffron proudly telling another person about  religiously fanatical violence he had previously organized in Uttar Pradesh. If you wish to find him, this is what he somewhat looked like: To answer your questions in order: 1.  Is education in India really led by worthy founders? We're a part of a  huge fraud ranging from this to IIPM (though I don't want to focus on  IIPM in this question). The sad thing is, education in India  is not led by any body. The institution owned by above mentioned person  is purely a profit making enterprise. Any education that results from  it is purely collateral damage. Students at such institutions are  literally directed to *worship* their founder, and a 3 storey tall print  of the same person outside Amity University is further proof of this  fact. (Did I mention there is a halo behind him?) He has in the  recent years worked on spreading education, and his school has a wing  for underprivileged girls. Does that make him the Robin Hood of Delhi  Education? Far from it. Without taking any credit away, I suspect the  entire scheme may even be an elaborate tax setup. But then, if he wishes to run his institution like a business, nobody can stop him. He is not flouting any major government regulations, and in fact has been awarded by the Government before: Non  profit boards do a much better job of running schools, and they should  be considered the true leaders of education in this country (DPS  Society, etc.) As far as the university is concerned, Higher  education has become one of the biggest cash crops in India. If the  British knew its monetary potential, they would be setting up  universities not Indigo plantations.  This is what we should be concerned about.  These days, anybody with enough capital can set up a university and  make a killing in the first year of operation. Who cares if thousands of  students are scammed in the process? Surprisingly, even though Amity  University was set up with the same questionable objectives, its much  better than IIPM or any of the other ones that have mushroomed. But the  concern still remains. I am an ardent supporter of privatization.  The best universities in the USA are private. IITs, which are in a sad  state themselves, are way too limiting to cater to the entire nation.  BITS is a very good example of a private university in India which makes  an effort to provide quality education. In short, I do not  believe that private universities should be discouraged from taking up  the mantle of higher education in our country. But until and unless a  university provides adequate education, and most importantly does original research and creates academic output of global standard,  it is NOT a university. Until then, we throw our country at the IITs  and keep what sticks. A bit like drinking through a fire hose. 2. Did the legal system not do its job properly in the above case? Was it influenced by the alleged parties? Yes,  of course the parties influenced the system. In India, you cannot even  get the legally right thing done without influencing the system. I'm  sure Mr. AKC contacted every important person in his network to help  with the problem. All of them had a varying effect, the cumulative of  which is that he continues to run this institution without a hitch in  the country today. The fact that it is an international issue  actually makes it easier for him. Extradition is definitely off the  table, but it is also difficult for the German banks to follow up on the  trial, which has been reduced to a domestic case. It makes the issue  open to a number of factors which can then be influenced by Mr. AKC  himself. 3. Can we fix the system? How? Join the Aam Aadmi Party. India is too big and too tangled up to fix in one day. There  is a theory which states that if ever anybody discovers exactly how the  Indian system works and how it can be fixed, it will instantly  disappear and be replaced by something even more bizarre and  inexplicable. There is another theory which states that this has already  happened.

Because these universities follows a simple "That which is seen is sold" concept either through advertisements or by sponsoring the IPL (Indian Premier League) teams. Probably This is the biggest reason why they never fail in getting more and more new admissions.

What a person madly wants today is education!!! "Degree" People know exactly which government/private institue is good so there's competition!! Result:Any way majority are left with no choice!! Anyway government is not really taking any steps bla bla Those who cannot pay go for some government college and then private colleges make market, those who can pay little more LL take risk and join private university!! Here is where institutes like amity manipal use their brains!!!!!..... Anyway people are getting degrees Difference still is what student does studies or gets diverted!!! Bottom line : quality and quantity of education needs to improve !!! Whether private / government!!!!!! Somewhere some people are lucky like me whatever institute they get good faculty willing to teach whether paid enough or not!!!! Can't blame privatization alone!!!
