How do you go about developing an application?

I have an idea of developing a software/programme or mobile application.....So should i go for applying a patent?

    Well short answer is that you can. But the bigger question is "Is it worth it ?". Patenting makes sense when - 1. Whatever you have invented has a very high commercial value. 2. You want to commercialize and make money from it. Patenting is a very long and expensive process. Defending the patent is another task. You need to make sure that it is unique and you are the first one to do it. And it will take you atleast 3 - 4 years to get the patent from the date of filing (Both India and US). It will cost you anywhere between 2 - 5 lakh rupees.

I applied for a patent for an anti-counterfeit system back on 2009, got it published in the IP Journal in February 2011 but thereafter it did not progressed a bit.   It is almost 4 years since i applied for patent.   And now i see the same concept  launched by many companies across the world! Chances are very low you get a patent for a business idea.  In the case of a software you will get patent for the source code you developed, but you cannot restrict somebody else developing another source code attaining same results. The only way in the software industry is silently develop the product and then launch the product and be the first in the market.  In parallel you can apply for a patent but do not depend on it.
