What legal issues can I face if I upload movies to my website and make them available for people to watch for free?
-
I have a huge collection of good movies. All are of good quality. And all those movies are very rare to find. I was thinking to create a website where I can upload the files and let the people watch the movies online for free. However I was thinking to post some advertisements. Is is legal to allow movies to be streamed from my website? I know lots of websites already do that. But now when it comes to law, is it even legal to upload movies on my website? However i will be showing the copyrights and all the related stuff.

Answer:
Civil liability: The owner of copyright can sue you for all the losses you are causing to him, which can be huge - leading to your bankruptcy. If you must do it at least do it through a company which will at least theoretically isolate your personal assets from this risk. However, courts may see through this and attach your personal property anyway. Also, any profit you earn through this website can be claimed and taken over by the copyright owner. A law suit like this will also cost you a lot of time, money and peace of mind. Also, very high penalties can be awarded under Information Technology Act against you if you use computers and internet for this copyright infringement. Criminal Liability: Copyright infringement can be criminal offence leading to prison time and arrest. Rare but entirely possible. Expect FIRs to be filed against you. Several states are making stringent laws to prevent piracy of movies - as in many southern states movie industry is immensely politically influential. These laws are making it possible for police to arrest you without warrant etc and additionally serious penalties and jail time- no matter in which state you live. Also, the heat it on India internationally to create a strict IP regime - and the government will be happy to severely punish people like you to show the good work they are doing. I'd be very careful if I were you. These are not good times to engage in this sort of piracy out of India.
