Typography: When is it OK for a designer to use an existing font for a logo design?

  • I've heard contradicting information about what is legally acceptable when it comes to using fonts when designing a company logo. If a designer has legally purchased a typeface (or if it is freely downloadable and listed as "commercial free"), can the font software then be used to create a vector logo? Or should the font creator or type foundry be contacted for permission (as font licenses often don't mention logo use)?

    I'm not sure there is one good answer for this. It seems to depend on the particular font company. I would think you are fine to use a free typeface that gives you a commercial free option (check the user agreement). I think it's not as clear cut for the others. For example, a similar question on the Adobe help site as answered by Adobe staff states: "All fonts licensed from Adobe permit at least preview and print embedding  (and incur no further royalties for distribution of PDF and EPS in  which such fonts are embedded), meaning that you may use such fonts for  logo design, print, etc." http://forums.adobe.com/thread/1181328 But this is from House Industries: "Logo Usage There is no additional charge for companies under $5 million (US  Dollars) in annual gross revenue. If the logo has a specific application  for a business within another company, then use the estimated gross  revenue for that venture. For example a logo for a major motion picture  would be priced on the movie gross, not the studio gross. $5 million to $10 million: $5000 $10 million to $50 million: $10,000 $50 million and over: $15,000" http://www.houseind.com/fonts/licensing/pricing/ A site like MyFonts sells fonts from multiple foundries each of whom may have different rules. Your safest bet, if you are not sure, would be to contact the foundry and ask.
