How do I develop an algorithm?

Can you train a neural network to develop an algorithm that gets around a existing troll-like patented algorithm?

  • Many machine learning folks seem to hate neural networks because many of the time we have no idea how they actually work at the end of the day.  But could this allow one to get around a troll algorithm patent?

    It doesn't matter how you developed the infringing algorithm.  Whether you read about the patented algorithm and copied it verbatim, whether you independently invented it, whether you developed it via a neural network or whether you had a spiritual medium project it from the astral plane -- if it infringes it infringes. The more interesting question would be if the algorithm was developed by a computer in the first place, whether it could be patented.  In that case do you even have an inventor?   But the case you give is one where the original inventor is a human.  So nothing special about that case.

In theory, it is "easy" to get around a patent - Just don't do one limitation. The trick though is what limitation in a claim can you skip and still have a valid product? A human expert is probably far more qualified to identify the claim element that may be done differently. Then you can probably use AI to search and find alternative solutions.
