What is defined as temporary employment?

In India, is it legal for corporations to force employees to sign a bond as a part of the employment offer that binds them to work for them for a particular (bond) period of time?

  • The Indian Constitution has provisions in the "Bonded Labour System Abolition Act (1976)" that prevents ANY kind of bonded labour that falls under the definition of "Bonded Labour and Bonded Labour System". I understand that the defintion of "bond" in the employment contract from the corporations is different than what is defined in the act, but, is it not philosophically the same to force an employee to work for an employer against the wish of the employee?

    Such provisions have a tendency to fall foul of S.27 of the Indian Contract Act - agmt in restraint od trade. There are times when they are enforceable if tempered with reasonableness. This is usually the case where a company has incurred substantial costs on specialised training for the employee.
