What is by-product pricing?

Is it OK to use competitor names and compare pricing on our website?

  • On our website we have created a webpage with a pricing comparison of our product with several competitors. Obviously, we are doing this because our pricing is as good/better than theirs. Pricing changes over time so we do caution people to check competitors sites - and provide links to them. One of the competitors contacted us: "Can you please remove <our name>, pricing information and all use of our trademarked name from your website: " Do we have to do this - or can we simply add some info about their name being a trademark? Do we have a right to use their pricing info (summarized from their public web page)?

  • Answer:

In UK and EU comparative advertising is permitted provided: ·        They are not misleading; ·        They compare goods or services meeting the same needs or intended for the same purpose; ·        They objectively compare one or more material, relevant, verifiable and representative feature which may include price; source: http://www.out-law.com/page-5604 :
