Would my site be considered "adult content" for AdSense?

Which countries do not penalize website's management if their site users upload and publish adult content publicly?

  • Hello community, we're from India, and we're working on coming up with a "user generated content" platform such as facebook or tumblr where users will be able to post their content and share it with friends and public. We've to know the safe places on earth, countries that have tolerant laws, that don't put the management team behind the bars making them liable for actions of their unknown platform users... Though we'll not allow adult content on our website and any abuse reported by anyone will be manually investigated at the earliest and the content will be taken down, but in the meantime, the content may go live and available to public... So before we start, we're deeply serious to select a location of incorporation and hosting on earth that won't take down our site/servers and won't make us accountable for the actions of our users that will be global! We're aware that from copyright perspective, USA has a well established piece of law which is the DMCA, and similar laws exist in European Union... but this issue of adult content uploaded by end users from anywhere on the global is a matter of grave concern that still needs to be addressed. Case studies will be : Tumblr, Facebook... Thanks a lot in advance. For options where we can incorporate and host our platform, we're looking at India, Singapore, Hongkong, Canada, California, Texas, Florida, Delaware, Ireland, Germany, Norway and Denmark as possible options.

    I don't think the source of the Adult Content is really relevant; whether it is user generated or posted by the website owners. Enforcement focuses on whether the content is taken down when a complaint is filed and whether the intent of the website is to server adult content (regardless of who posts it). Clearly countries that allow adult content, those with generous free-speech protections or lax restrictions, are a safe bet: United States, nearly all European countries, Brazil, Russia, and so on. Not sure it matters where you incorporate. I think server location is the deciding factor for most enforcement of this sort of censorship. Ultimately, if you are worried that your business plan is illegal, talk to a lawyer. This is their specialty, after all.
