How is this considered a business company?

If a foreigner incorporates a company in the United States and becomes an employee of it, is that considered being in business for oneself or being an employee?

  • I can only work legally in the United States as an 'employee.' Self-employment is not allowed. Would being an employee of my own corporation be considered self-employment or employment?

  • Answer:

In general, yes, working for your own company is considered the same thing as being 'self-employed.' There are situations where this may be possible, but these cases can be quite challenging. If you're serious about this, I recommend you read the following: http://www.murthy.com/2013/03/26/entrepreneur-h1b-petitions-a-new-option-for-start-up-companies-2/ Please note that the prohibition against 'self-employment' usually comes up in the H1B context. However, there are certain visa classifications (e.g. E-1/E-2) where being self-employed is perfectly acceptable.
