Where can I get my R.N. license?

Can my wife get her RN license AND possibly get a job if arrested for DV but no charges pressed?

    The California Nursing Board requires reports only of convictions, not arrests. http://www.rn.ca.gov/enforcement/convictions.shtml This comports with the California Labor Code: "No employer, whether a public agency or private individual or corporation, shall ask an applicant for employment to disclose, through any written form or verbally, information concerning an arrest or detention that did not result in conviction, or information concerning a referral to, and participation in, any pretrial or posttrial diversion program . . . ." (Labor C 432.7(a).)

Yes no charges were filed but she still was arrested. So she does have an arrest record did she get fingerprinted? I'm dealing with the same kind of worries about background checks and I know that in certain states who work closely with clients or patients as a nurse does even if the case is dismissed or sealed and never filed it will show up that she has been arrested. So if in your state by having an arrest record cannot you employment depends on your state. She might be excepted to school but she also might be not eligible for a RN license. Researcher state guidelines regarding nursing certification or licensure and you will see what requirements are needed and what will disqualify her for a license. I'm just not sure if an arrest record is permanent or if you can get it removed somehow. For that you must do some more research and get free consultation with an experienced lawyer that is familiar in cases like your girls.

If no charges were pressed, she is ok. Hope she learned a lesson. If she ends up with a criminal history someday, no one will hire her.
