My guess is yes given that he is not an authorized distributor of the paper, and not a paying advertiser. You see, people PAY MONEY to advertise in the paper, even the free papers (that's how they are free). The spirit of the free paper is that you take ONE. I can't give a specific law, but I would virtually guarantee that he is breaking one.
