Should I trademark my website name?

If someone owns a website that is a trademark or individual's name and is selling email addresses on it, does that qualify as cyber squatting?

  • The website is my last name at a .US domain.  I know cyber squatting is defined in US law as holding a domain for the purpose of selling it to the person or trademark holder for a profit.  Not sure if this would qualify?

    It does not matter is this qualifies as "cybersquatting". The only question here is: does someone have a website URL that matches your registered trademark. If you have this trademarked, you might be able to get the domain transferred to you for the purposes of running your website on this domain. If both the "cybersquatter" and you have similar registered trademarks (in non-competing businesses, presumably), then it becomes much trickier. ICANN is going to see who has the better claim to that domain. A federally registered trademark would trump a local trademark, for instance. You probably want to read the information directly. Trademarks are associated with a "business'.  Trademarks on names are also quite rare. The key test would always be: Would the average user confuse the particular web site with the services you provide under your trademark?  So unless your trademark is associated with the business of selling e-mail addresses, the website owner is doing nothing wrong.
