You may be able to beat it with some research done on your part. It is not worth getting a lawyer for a seat belt ticket and I'm not going to take the time to look it up, but if you look for Maryland Traffic Case Law, you should be able to find a case that is precedent for Maryland having two separate charges. NOT Wearing a seat belt and IMPROPERLY Wearing a seat belt. Use that case law as your defense and a judge in any state will be hard pressed to convict on a charge that is not defined in their state motor vehicle code, but has been challenged and defeated in another state.

If you don't wear the seat belt correctly, it would be equal to not wearing one at all. You could try to argue the ticket but I doubt it will help given that you admit to wearing it incorrectly.

There would be no difference because not wearing one or wearing one incorrectly is the same thing.......
