Employment law ...is this discrimination?

You need a professional opinion on this, but i think the company are perfectly free to do what they are doing...it's called an incentive. There may be a way that if abscence can be shown to be due to sickness that overrules the standard for the draw.

each state has it sown set of employment laws however this is not discrimination due to the fact that it does not single out and protected class (sexual orientation, race, gender, etc..) if you have benn off due to sickness, did you file any family medical leave documentation? if not, then you are not protected by that federal law either. this is a benefit provided by your employer, not a requirement. in wisconsin, where i live, a law just passed stating that anyone who has missed work for more than 6 days in a year, is not eligible to even receive unemployment payments.

No, It is unfortunate that you can not win due to illness but this type of contest is to inspire those who are not sick to not miss work because they just want a day off.

No, discrimination is based on age, sex, gender and religion. If you choose to call off sick than that is your choice, you could have gone to work sick.
