Wrongful Termination in Texas?? Do You think we have a case?

  • My husband was fired from his job yesterday. I understand that in Texas, an employer or employee can terminate employment without notice. WELL my husband wasn't given a ...show more

  • Answer:

Texas is an "at will" employment state, meaning that unless they broke the law while firing your husband (i.e. discrimination, sexual harassment), they don't have to give any reason whatsoever. Doesn't hurt to talk to a lawyer, and many companies will settle just to avoid a hassle.

Unless he can prove his termination was due to something like his race or age over 40, it's not "wrongful termination" - they canlegally fire him without giving him any reason, or actually without even HAVING a reason although that would be really stupid. He might as well file for unemployment, and might or might not be approved.

I found assistance from an attorney over on www.lawyersearchsite.tk

If your husband was in a "work at will" job, then he can quit or be fired, for any reason or no reason at all (as long as it's not discriminatory), and with or without notice. You don't need a lawyer to tell you to file for unemployment benefits. File for them! It's not an admission of anything other than you were let go from your job "through no fault of your own". The company he worked for would have to appeal the claim and have evidence that proves he was fired for gross misconduct for him not to be eligible.

Your right, your Not going to get rich on this, the best you'll get is an unemployment check and you don't need a lawyer for that. Maybe his job back, of course the lawyers your paying are going to tell you different that for as long as your paying. goodluck

You can't really claim wrongful termination b/c you don't know why he was terminated. I would be using the lawyer to get HR to give him a reason why he was terminated.

I don't understand why you would hire a lawyer to see if you should file for UI. Of course you should. If they gave him no reason then he will probably get UI.
