Is there a legal definition of African-American in the US?

In the US, what is the legal definition of self defense?

  • Looking for a brief overview.  I realize the definition may differ from state to state, but looking for some general guidelines.  How much force can you exert against an attacker, without getting yourself into legal hot water?

  • Answer:

It varies from state to state, as you note, but the general rule at common law is that you can use a similar amount of force as is intended against you.  That is to say, if you're being punched, you can punch someone back - but you can't use a gun.  However, if the threat is of imminent danger to your life (such as a knife), then lethal means may be acceptable. Obviously, this gets into odd hypotheticals - is a baseball bat a "deadly weapon"?  How about a 3" pocketknife?  Tweezers?  It's ultimately a question for the finder of fact (jury or judge) to determine, whether you were reasonably in fear for your life and responded accordingly. This answer is not a substitute for professional legal advice....
