So if you break up, he could seek custody and child support, FROM YOU, for your own child. Having the same last name is not what makes you a family. Protect your child.

In some states it is allowed and in others it is not. Not such a good idea though~~with so many marriages ending in divorce many Judges will not allow it in their court rooms.

It will help if you are married, contact a family lawyer. There is a lot of paperwork to be done and I've no idea what the current cost would be.

If he's not looking to be married yet, then he's probably not looking for a lifetime commitment of any kind, at least not to you. Therefore, why would you want to put your son in a lifelong legal relationship with this man? Even if it's possible for a non-spouse to adopt your kid--which it may not be in your state--adoption means that your BF would still retain visitation rights and all the full decision-making rights of a parent, if you and he ever split up or divorced. He could even conceivably take custody away from you, if he could convince the courts you're unfit in some way. If this guy isn't worth you legally committing to (that is, marrying), then for crying out loud, don't try to give him legal control of your kid.

If you're not even willing to be a family with this man through marriage, or if he's the one "not looking to get married" then why would you want him to adopt your son, and why should a judge allow a man to adopt who is not willing to commit to a family?
