Working for a foreign company as a freelancer! Am I covered by EU Employment Law?

  • I work in the UK but for a foreign company. I am a freelancer. Under EU law I am entitled to paid leave and other protections under the EU working times directive. Does this still ...show more

  • Answer:

If the company is doing business in the EU, one would generally fall under the laws of the region that they are actively doing business in. However, if you are a freelancer, you are not actually employed by the company in question, you are self employed. The company is not required to do anything beyond the contract you may or may not have with the company, and only need to pay you for the work they hired your company (for legal purposes, a freelancer or self employed individual is defined as a company) to do. You might just want to quiet down, and quit making so much noise or it is quite possible that you will find out the hard way that it is quite expensive to provide all those "entitlements", when the laws are applied to yourself, as you indeed are considered a company if you are freelancing.

Check your contract, and if that is not clear, check with the HR department for the organisation you work for. It often is a case of contracts and small print.
