  • Answer:

There is nothing in the Service Members Civil Refief Act that allows someone to return a newly purchased car. The courts support that you cannot do adverse action to an active duty service member based on their pre-service debt (they can't garnish, they can't foreclose, etc). That does not mean they were required to take the truck back. They weren't. If he qualified for any relief from the Service Members Civil Relief Act (which it's iffy, if he did). They were not allowed to come after the loan balance while he was on the overseas assignment. The lender could not consider any of the bills outstanding (i.e. late) while he was away. They could have put the loan on "hold" for him. - since he was on active duty when he purchased the truck, the law probably doesn't even apply They made good on the first car, they are not required to sale him another car. Since it's not on his credit report, he can go to any other dealership and purchase another car.
