Is it ok for my 5 year old to be in a backless booster car seat?

if shes just 40lbs, i'd definitely consider getting her a 5pt harness seat like the graco nautilus. its not too pricey, and it'll kepe her safer in a 5pt harness for several more years! it then converts to a highback booster and a regular booster, so you could easily get 4+ more years use out of it!

If you want her as safe as possible, she should still be in a 5 point harness. She should have been rear facing to 40 pounds. I suggest you look at a Graco Nautilus, it goes from 5 point harness to high back booster to backless booster, you'll never need to buy her another car seat! Not sure what your local laws there are, but children here have to be in a booster until their 8th birthday
